Jono Cole, Associate

Jono is an Associate at Ford Sumner, practising in corporate and commercial, as well as commercial and medico-legal litigation.  He joined Ford Sumner in 2013, after working as a Consultant at a Big 4 advisory firm in Wellington.

Jono has extensive experience advising a broad range of local and international clients including individuals, companies and public sector entities on corporate, commercial, property, insolvency, regulatory and dispute resolution matters.

Jono has appeared in the District Court, High Court and Court of Appeal (as Junior Counsel), and assisted in all aspects of litigation preparation in specialist Tribunals and Courts at all levels.

He has particular interest in commercial insolvency and debt recovery litigation, and advises liquidators and creditors on all aspects of recovery and enforcement proceedings.

Jono’s particular experience includes:
  • Representing the Accident Compensation Corporation in Review hearings and District Court appeals;
  • Advising liquidators on all aspects of liquidations, including liquidators’ statutory powers and duties, asset and business sales, and representing liquidators in proceedings against directors, shareholders and creditors;
  • Civil debt recovery litigation in the District Court and High Court, including default judgment, summary judgment, defended ordinary proceedings, and uncontested and defended bankruptcy and liquidation proceedings;
  • Advising corporate clients on all aspects of mergers and acquisitions, including share and asset sales, shareholder agreements and disputes;
  • Advising corporate clients on Companies Act 1993 matters, including directors’ duties, shareholder and governance matters;
  • Advising on property transactions, including all aspects of leasing, residential tenancies and conveyancing;
  • Acting for Principals and Contractors in relation to disputes under the Construction Contracts Act 2002 and the NZ3910:2013 Standard Conditions of Contract for Building and Civil Engineering Construction;
  • Acting for franchisees in dispute with a franchisor in relation to alleged breaches of franchise agreements; and
  • Acting for a director in an application under sections 386A and 386E of the Companies Act 1993 for an exemption from the prohibition of being a director of a phoenix company and for permission to be a director of a phoenix company.
In his spare time, Jono is a keen sportsman, enjoying running, swimming, skiing and snowboarding.  He’s also often seen out chasing after his Golden Retriever Lola at the beach.
